What is the role of the Chartered Accountant of a Work's Council?
The French institutional framework includes legal rules and regulations which are the basis of the relationship between the companies and their staff. The French Labour Code is founded on all these rules and regulations.
Concerning the representation of the staff, the French Labour Code requires in particular the creation of a Work's Council when 50 people at least are employed by the same company.
   
The Work's Council is in charge of the following matters:
  • the management of the Social and Cultural Activities (SCA). The company puts up money for these activities. They may be as different as staff catering, sports and leasures, mutual help and culture.
  • the running of the company in its various fields (economical and financial, labour conditions, professional training).

The Board must consult the Work's Council about their decisions concerning the running of the company before processing them. This procedure can't be mistaken with joint management. Indeed,

  • even if the Managing Director of the company is free to take in account or not the comments or the adjustments given by the staff representatives ...
  • ... he can't realize its poject without their advice. If he oversteps, he is in breach of the law and may be subject of penal sanctions.

This procedure requires that the Board of the company has to give the necessary information to the staff representatives of the Work's Council to make them able to understand the project and to give their advice, which is required before the implementation.

In the framework where the staff has the right to be informed about the situation of their company through their representatives, the abilities of the Chartered Accountant of the Work's Council are written into law.
